1. General

You enter into a usage agreement with GAIA AG (hereinafter "GAIA"). By accepting these terms, they become part of the contract for the use of sentiga.

2. Subject matter

2.1 The subject of these terms is the use of sentiga. sentiga is an AI-powered lifestyle tool and offers general information and impulses to promote general well-being and personal development.

2.2 Using sentiga is not a substitute for a diagnosis or medical or psychotherapeutic treatment. Messages entered in the chat are processed exclusively by machines and are not read or monitored by humans in real time. sentiga is not suitable for acute crises or emergencies.

2.3 Beta phase (Early Access): sentiga is currently in a free beta phase and is being developed continuously. The application may contain errors; individual features may change, be restricted, or be discontinued. There is no entitlement to uninterrupted availability, freedom from errors, or permanent continuation of the service. GAIA may adjust, interrupt, or terminate the beta at any time. We appreciate your feedback.

3. Access and registration

3.1 Registration is required for use. By registering, you accept these terms.

3.2 Registration and sign-in take place with an e-mail address and password. A one-time code is sent to confirm the e-mail address.

4. Data protection

Information on the processing of personal data can be found in our privacy policy.

5. Your rights of use

5.1 For the use of sentiga you receive a simple, non-exclusive, and non-transferable right of use. This does not include any acquisition of the content.

5.2 You acknowledge that you have no ownership rights to your user account.

5.3 sentiga is generally available at all times. Availability may be temporarily restricted for technical reasons (e.g. maintenance).

6. Your obligations

6.1 You choose individual login credentials for whose confidentiality you are responsible. In case of misuse, you will inform GAIA. GAIA is entitled to block the affected access. You are liable for any misuse attributable to you.

6.2 You bear the device and telecommunications costs incurred for use yourself.

6.3 You are responsible for establishing the technical requirements for access and for using the program from a secure environment.

6.4 Entering sensitive data: Since sentiga is an interactive, AI-powered chat tool, we expressly instruct you not to enter sensitive personal data (e.g. full name, address, contact details) into the chat field.

7. Permitted use and misuse

7.1 sentiga is intended exclusively for its designated purpose as an interactive lifestyle tool for use by natural persons.

7.2 Use by automated systems (bots, crawlers, scrapers, scripts, or similar) is prohibited.

7.3 Fair use: You undertake to use the service only to a customary and reasonable extent. GAIA reserves the right to introduce technical restrictions (e.g. rate limiting) to prevent misuse and disproportionate load on the infrastructure.

7.4 Attacks and manipulation (e.g. malicious code, denial of service, circumvention of protective measures, "jailbreaking" or "prompt injection") are prohibited.

7.5 Liability for costs in case of misuse: In the event of a culpable violation of this section 7, you are obliged to compensate GAIA for the resulting damages, costs, and expenses; this includes in particular costs for the use of the server and AI infrastructure.

7.6 Blocking and termination: A violation of this section 7 is deemed a material breach of contract. GAIA is entitled to block access immediately and to terminate the contractual relationship without notice.

8. Disclaimer

8.1 GAIA is not liable for damages arising in connection with the use of this program, unless otherwise stipulated below.

8.2 The information constitutes non-binding output of an AI-powered dialogue system. Errors cannot be ruled out. No guarantee is given for accuracy, completeness, or timeliness.

8.3 GAIA assumes no liability insofar as information is used, contrary to its intended purpose, for self-diagnosis or self-treatment, or a necessary medical consultation is omitted.

8.4 GAIA is not liable for lost profits, data loss, consequential damages, or damages due to business interruptions.

8.5 sentiga may contain links to third-party websites. The respective operators are solely responsible for their content.

9. Copyright

9.1 The content of sentiga is subject to GAIA's copyright.

9.2 You may download material for personal use. Passing it on to third parties or commercial distribution is not permitted.

9.3 Images, graphics, audio files, and the layout of sentiga are the property of GAIA and may not be reproduced or distributed.

10. Artificial intelligence (AI)

10.1 sentiga uses generative language models to provide interactive chat responses and text-based content. This content is generated dynamically.

10.2 Due to the way generative AI works, the system may occasionally produce incorrect, inaccurate, or fabricated information ("hallucinations"). You are advised not to rely blindly on the output.

10.3 The AI content is exclusively of a supporting and informational nature and does not replace medical or psychotherapeutic advice, diagnosis, or treatment.

10.4 Responsibility for the interpretation and use of AI-generated content lies with the user.

11. Updates / changes

11.1 GAIA reserves the right to make changes or additions to the information provided.

12. Final provisions

12.1 The law of the Federal Republic of Germany applies.

12.2 The place of jurisdiction for all disputes arising from this contractual relationship is Hamburg.

12.3 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
